No doctrine of Pufendorf's is better known than that of socialitas. The reason is that Pufendorf himself declared that socialitas was the foundation of natural law. No interpreter of Pufendorf can therefore avoid dealing with it. Moreover, Pufendorf linked the issue of socialitas to the question of the state of nature, thus raising important issues with both theological and philosophical implications. Given the prominence and importance of this theme in Pufendorf's work, a close analysis of what he meant by it (...) is central to the interpretation of his work, even though this means to pose again a new number of questions already discussed in the scholarly literature. In particular, this article examines the relationship between Pufendorf and Hobbes with regard to this central theme. In fact, a traditional historiographic topos is that Pufendorf and Hobbes fundamentally disagree on the doctrine of socialitas, while the former is closer to Grotius and to the Aristotelian-classic tradition that see man as a social animal. This article takes, instead, Pufendorf to be a follower of Hobbes, and tries to explain how the more traditional view of Pufendorf as a critic of Hobbes was in some way due to Pufendorf's own attempt to distance himself from the accusations of Hobbesism (and hence of atheism and moral indifference) that the critics made against him when his work first appeared. In order to do this, Pufendorf tried to rethink his own position within the history of ethics, and put himself on the side of the Stoics, of Grotius and of Cumberland, against Epicurus and Hobbes. This retrospective ‘illusion’ has greatly influenced later scholarship, giving us a distorted image of Pufendorf's own view of socialitas. A more precise account of the latter gives a better prospective from which to look at the relationship between Pufendorf and Hobbes. ☆ The publication of this text, in this form, may require some explanation. In what it now appears the very distant June 1989, the Max-Planck-Institut für Geschichte in Göttingen organised an International Workshop on ‘Unsocial Sociability: Modern natural Law and the 18th-Century Discourse of Politics, History and Society’. The proceedings of that Workshop were never published, even though individual contributions have piecemeal appeared since then. My own contribution consisted in a short extract from a chapter from my book Samuel Pufendorf discepolo di Hobbes. Per una reinterpretazione del giusnaturalismo moderno (Bologna, 1990), which appeared in print the following year. For this reason, I considered the separate publication of that intervention as superfluous. Rather naively I underestimated the fact that the publication of my book in Italian restricted its circulation in the Anglo-American academic circles, and even if occasionally quoted, the book would not be much read. Recently, following the solicitations of many friends to present in English part of the theses developed in that book, I had decided to have my intervention at the Göttingen Workshop finally published. After all, this had amply circulated as a manuscript and been cited by many in that form. But while I was planning to revise that manuscript, I was presented with the draft translation of the second chapter of my book done by Dr. Melissa Calaresu of Cambridge University, when she was still a graduate student. It is probably better to leave aside the story of why Melissa did that translation, but I am extremely grateful to her for having allowed me to use it as the basis for this piece, which is therefore a revised version of the second chapter of my Italian book on Hobbes. I have decided to publish it in English with some hesitation, at least for two reasons. First, because with the publication in English of only part of my book I may risk to reinforce a rather simplified interpretation of my work, and consequently of Pufendorf's thought, that his main contribution lies in his doctrine of socialitas and of the state of nature. I am instead firmly convinced that the most important parts of my own work are those that are still untranslated, that is those on the nature of moral obligation and that of moral entities, beside the comparison I make in the second part of the book between the first and the second edition of De iure. Secondly, because during the intervening years I have distanced myself from a conception of the history of philosophy understood as an internal analysis of the texts, and have become more attentive to the context in which to place philosophical texts. I have therefore developed a slight impatience towards the rather nick-picking analysis of texts, which with a certain virtuosism I performed in the book. Nonetheless, since even after so many years I do not believe that the theses I developed in that book have lost their force, I am happy for this partial translation, with some essential bibliographic updating, to appear, in the hope that such theses will be finally discussed for what they are and not on the basis of second-hand reports. This paper focuses on the materialistic account of the blending and the way it shapes an original organism model. I aim to shed light on the threads of connections we can gather between the Presocratic and the Stoic views on the physical krasis of the body. The Stoics share with Parmenides and Empedocles the idea of a single material cosmic continuum in which thought and perception depend on the various blendings of the physical constituents of the body. Both of these (...) naturalistic traditions are committed to the view that substance is continuous and undergoes constant and qualitative change. My point is to underline how this view of a sympathetic cosmos presupposes a model of the individuality that is radically open. Thus, by taking off the notion of the krasis, the Stoics take off a problem – namely, that of the organism – that is first fleshed out by the Presocratics – Parmenides and Empedocles in particular – philosophers. In this respect, the Stoic view of relational identity indebts to the Presocratic account, beyond and against the Aristotelian one. (shrink)

El objetivo del presente trabajo es mostrar, a través de un análisis del primer curso académico dictado por Heidegger en 1919, las deudas teóricas que el filósofo contrajo con la fenomenología de Husserl. La construcción por parte de Heidegger de una fenomenología hermenéutica se vale de conceptos elaborados por Husserl tanto en las Investigaciones lógicas como en Ideas para una fenomenología pura y una filosofía fenomenológica. En efecto, se mostrará cómo Heidegger, gracias al auxilio de la noción metodológica de desconexión, (...) puede superar la ingenuidad de la actitud natural, por un lado, y comprender la riqueza preteórica de sentido de la vivencia, por el otro. This paper aims to shed light on Plato’s myth of Er contribution to the emergence of a conception of choice as a principle of identity. Our hypothesis is that this myth brings out what is a real choice and that only philosophy enable us to make it. Philosophy as a way of life is that according to it our choice of life become a free choice and a principle of identity — because this first choice determines all the others in (...) the entire life. From this view, I propose to assign Cicero’s voluntas and Epictetus’s prohairesis — as faculty of choice and principle of personal identity — to this point of the myth : philosophy appears as the way to make the choice to choose. The paper presents important new information about the life of Jean Barbeyrac, the famous Huguenot translator of Grotius, Pufendorf, and Cumberland. Based on extensive research in the Secret State Archives (Geheimes Staatsarchiv) and the archive of the French Church (Französicher Dom) in Berlin, it discusses two previously unknown letters of Barbeyrac to court officials, and the role of this interaction in his departure, in 1710, to the University of Lausanne. It also reintroduces a relatively unknown work by Barbeyrac on gambling, (...) the Traité du Jeu (1709), and clarifies the role of various personages in the French Colony of Berlin in the early eighteenth century. The investigation articulates various family relationships of Barbeyrac and follows him to the University of Groningen (in 1717)—a relatively unexplored period of his life—whose archives have recently yielded a comprehensive inventory of his possessions. Also, by analyzing documents dealing with the life of Barbeyrac's brother, Jacques, the paper contributes to our understanding of the early modern pastorate in Brandenburg (Prussia). A prelude to a larger study of Barbeyrac and the Huguenot diaspora in Berlin, it focuses on essential texts, both old and new, which are needed for an adequate understanding of this formative period of the early German Enlightenment and its main figures. The best I could write would never be more than philosophical remarks." The fragmented character of Investigations is matched by its other formal oddities and difficulties: (...) its metaphors, its cryptic evocative obscurity about some things and its linguistic precision about others, its dramatization of philosophical positions in stories, in hypothetical worlds, and in the role of the interlocutor(s). Our initial and continual problem in reading Investigations is to understand the reason for its form, and to justify this form relative to its philosophical concerns and methods. I will argue that the justification of the form of Investigations comes down to a single question: how do we take up Wittgenstein's example—in thinking and in confusion—without mimicking him?IThe justification pursued in the preface bears affinities with theological justification, defined as our becoming righteous relative to God, as Calvin characterizes it, "an acceptation, whereby God receiving us into [End Page 428] favour, taketh us for righteous" (Institutes III. xi. §2).1 Righteousness as a mark of acceptation, the very tone of "righteousness" and God's power of acceptation, have no direct counterparts in Wittgenstein's philosophy. Philosophical justification does not have a doctrinal foundation that would establish any particular content nor any special relation between the pursuit of that justification (through philosophy) and its fulfillment, even hypothetically, in some possible acknowledgment of righteousness. The seriousness betrayed by Investigations need for justification, however, is expressed in the moral fervor of Wittgenstein's philosophizing. It is also his philosophical goal to encourage a kind of acceptation that the ground of our involvement in the world, in what constrains and confuses us, is no more than how we live and what we are: "Instead of the unanalyzsable, specific, indefinable; the fact that we act in such-and-such ways, e.g. punish certain actions, establish the state of affairs thus and so, give orders, render accounts, describe colours, take an interest in other's feelings. What has to be accepted, the given—it might be said—are facts of living" (Remarks on the Philosophy of Psychology, §630; c.f. PI, p. 226d).2 The translators comment in a footnote that a variant for "facts of living" in Wittgenstein's manuscript is "forms of life." What has to be accepted are forms of life.The form of Investigations is justified as part of a discovery, with or without a supporting theology, of how to move ourselves toward some greater form of perfection (although not to reach it). The Protestant cast of this justification, in Wittgenstein's case, is just (and I wouldn't want to extend it further) that while this justification is achieved by virtue of our effort, it is not effort towards the world, but towards our intransigent will, and that the grace that might enable our work is less a gift, than a condition within which we can struggle.3 Thus, "what has to be overcome," in philosophy, "is not the difficulty of the understanding but of the will" (CV, p.17).4 Philosophy for Wittgenstein is a form of self-education. One works on the will in order to see differently: but the will is neither a thing nor a faculty. Working on the will is not a psychological project of self-reform, but a reconstitution of our attitude toward what we take as necessary. We can describe such attitudes with the vocabulary of the passions by which express or curb our will: devotion, derision, hope, fear, confidence, indignation, pride, repentance, emulation, gratitude, consternation, daring, timidity, and so on. And thus "philosophy is a work on the will" is kind of maxim to help us remember a kind of attitude, purpose, and justification.I will derive an agnostic notion of justification from its Protestant [End Page 429] theological form, retaining its moral force and claim on our person, but without psychologizing it, with minimal doctrinal content, and without God. A poem is not particular in the way a painting is particular. A copy of a poem is still the poem, while a copy of a painting is not the painting. But a poem is still particular, since it seems to be constituted by a specific set of words in a specific order such that to alter that order or any of those words is to make a new poem. Marianne Moore begins her poem “An Egyptian Pulled Glass Bottle in (...) the Shape of a Fish” in the following way: She might have revised this and replaced “perpendicularity” with “verticality.” This says the same thing, but it is not the same poem. Fiammetta Palladini's work is one of the most important discussions of Pufendorf to appear in the latter part of the twentieth century. It cut through the existing field of Pufendorf studies, laying bare its inherited templates and tacit assumptions. Palladini was thus able to peel back the 'Grotian' commentary in which the great thinker had been shrouded, revealing a Pufendorf well-known in the 1680s-a formidable and dangerous natural jurist and political theorist-but doubly obscured in the 1980s and still today, (...) by a philosophical history that flies too high to see him, and by a commentary literature that too often does not like what it sees. Music’s original philosophical problem is ontological: what is it? In this paper, I argue that music has a better philosophical beginning; philosophical accounts of music should begin as philosophical accounts of listening to music. What distinguishes listening to music from hearing sound? My aim is to give a philosophical account of music by means of a description of a particular kind of interactive relationship we sometimes have to sound. Music, I shall argue, is not distinguished from sound because it has (...) a special metaphysical status or because of the psychological reactions it produces in us; musical sound is distinctive because we listen to it in a certain way. I explore some of the ontological implications of my account, both for music broadly speaking and for the ontology of musical works. (shrink)

The primary aim of this chapter is to explain the nature of evidential reasoning, the characteristic difficulties encountered, and the tools to address these difficulties. Our focus is on evidential reasoning in criminal cases. The academic dominance of cultural studies and the increasing interest and significance of cultural conflict in our world has encouraged various theories of culture, the most pervasive being theories of transculture and hybrid cultural forms and entities. In this guest column, Bourbon argues that all such trans theories are fundamentally flawed and distort the very idea of culture. His essay analyzes the concept of transobjects and transcultures, looking both at the assumptions supporting such objects and ideas and at their (...) explanatory uses. This discussion leads to one on the relationship between texts and contexts. Most cultural theories, and all transcultural theories, confuse the relationship between texts and contexts, specifically misusing the idea of the conditions of possibility, while relying on various forms of personification. Bourbon both criticizes these ideas and also offers a more modest idea of culture, along with specific suggestions on how to study and understand what we call “products of culture,” including fictions and ourselves. Autopoiesis provides a systemic language for speaking about intrinsic teleology but its original formulation needs to be elaborated further in order to explain sense-making. This is done by introducing adaptivity, a many-layered property that allows organisms to regulate themselves with respect to their conditions of viability. Adaptivity leads to more articulated concepts of behaviour, agency, sense-construction, health, and temporality than those given (...) so far by autopoiesis and enaction.
